Terms of Use

Last updated: 14 October 2026

These terms cover your use of tamim490.com.au (the "site"). By using the site you agree to them. If you do not agree, please do not use the site.

1. Who runs this site

The site is run by Mark McCarthy and Caren McCarthy as trustees for the MMC & CMC Family Trust (ABN 62 404 322 150), trading under the registered business name Tamim 490 ("Tamim490", "we", "us", "our"). Contact: [email protected].

2. What these terms cover

These terms cover the site only: its pages, forms, free tools and any private page we send you a link to.

They are not the terms of our coaching, advisory or wellness programs. A paid program is covered by a separate written agreement, which we give you to read before you accept it or pay anything. That agreement sets out the price, the payment plan, and the cancellation and refund terms. Nothing on the site is an offer you can accept by using the site.

3. General information, not advice

The content on the site is general information about business, leadership, health and wellbeing. It does not take your circumstances into account. It is not legal, financial, tax, accounting, medical, nursing, psychological or other professional advice, and you should not rely on it as a substitute for advice from a qualified professional.

Health and wellness pages describe coaching and support only. They do not diagnose, treat or prevent any condition. Talk to your doctor before changing medication, diet or exercise. In an emergency, call 000.

Stories and examples on the site describe other people's experience. They are not a forecast of your results.

4. Free tools

The Job Docket and the Business Check-in work only from the numbers and answers you enter. What they show is an estimate or a general reading to help you think. Check the figures yourself, or with your accountant, before you act on them.

5. Private pages

We may send you a link to a private page, such as a proposal or a check-in result. A proposal page opens with a one-time code sent to your email address. These pages are for the person we sent them to. Please do not share the link or the code, or try to open a page that was not sent to you.

6. Using the site

You agree not to:

  • use the site for anything unlawful;
  • submit false details, or another person's details without their permission;
  • try to get around the security or spam protection on the site, or interfere with how it runs; or
  • use automated tools to submit forms or to copy the site in bulk.

7. Our content

We own, or are licensed to use, everything on the site, including the text, images, video, tools and the names Tamim490, Foundation28 and Ascend90. You may view the site and print or save pages for your own personal use. You may not copy, republish, sell or adapt the content, or use it to deliver coaching, consulting or training to anyone else, without our written consent.

8. Other websites and services

The site links to, or uses, services run by other companies, for example the booking calendar, video player and social media pages. We do not control those services and are not responsible for their content or for how they operate. Their own terms and privacy policies apply when you use them.

9. Your privacy

Our Privacy Policy at tamim490.com.au/privacy explains what personal information we collect and how we handle it.

10. Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

Subject to that, and to the extent the law allows:

  • we provide the site as it is, and do not promise that it will always be available, free of errors or up to date; and
  • we are not liable for loss that results from your use of the site or from a decision you make based on its content or tools.

11. Changes

We may change the site or these terms at any time. The current version is always at tamim490.com.au/terms, with the date it was last updated at the top.

12. Governing law

Queensland law governs these terms. Each party submits to the non-exclusive jurisdiction of the courts of Queensland.
